In exchange for the right to use and access the Cavalier Cigar Company’s cigar lounge (“Cavalier Lounge”) as a guest of a Cavalier Lounge Member (“Member”), the party signing hereunder and referred to hereinafter as “Guest” hereby agrees to the terms and conditions of such use and access as described in this Guest Access and Indemnity Agreement (“Agreement”).

Guest may only access and remain in the Cavalier Lounge while accompanied by a Member and upon signing this Agreement.

Guest agrees to read and abide by the Lounge Rules, a current copy of which is available for review along with this Agreement.

Guest agrees that while on Cavalier’s premises as a Guest of a Member, that he is a licensee and not an invitee, and is subject to the same restrictions and obligations as a Cavalier Lounge Member.

GUEST AGREES TO INDEMNIFY CAVALIER CIGAR COMPANY (“CAVALIER”) AND THE OWNERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS OF CAVALIER, AS WELL AS ANY PARENT, SUBSIDIARY, OR SUCCESSOR ENTITIES TO CAVALIER AND THE RESPECTIVE OWNERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS THEREOF (collectively, the “CAVALIER PARTIES”), AND HOLD THE CAVALIER PARTIES HARMLESS FROM ANY AND ALL DAMAGES, CLAIMS, DEBTS, LIABILITIES, DEMANDS, OBLIGATIONS, COSTS, EXPENSES, OR ACTIONS, BASED ON, ARISING OUT OF, IN RELATION TO, OR IN CONNECTION WITH MEMBER’S OR GUEST’S USE OF OR ACCESS TO THE CAVALIER LOUNGE OR CAVALIER’S PRINCIPAL PLACE OF BUSINESS, REGARDLESS OF CAUSE, EVEN IF CAUSED IN WHOLE OR IN PART BY A PRE-EXISTING DEFECT, THE NEGLIGENCE (WHETHER SOLE, JOINT OR CONCURRENT), GROSS NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL FAULT OF THE CAVALIER PARTIES. 

AGREEING TO THIS DOCUMENT INVOLVES THE WAIVER OF VALUABLE LEGAL RIGHTS.
